PLEASE READ ALL OF THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT BEFORE USING OUR APPLICATION. WE ARE PLEASED TO LICENSE THIS APP TO YOU AS THE INDIVIDUAL, COMPANY, OR OTHER LEGAL ENTITY THAT WILL BE UTILIZING THIS APPLICATION (REFERRED TO BELOW AS "YOU" OR "YOUR") ON THE CONDITION THAT YOU ACCEPT ALL OF THE TERMS OF THIS AGREEMENT. THIS IS A LEGAL AND ENFORCEABLE CONTRACT BETWEEN YOU AND Innovana Astro Services Limited AND BY CLICKING ON THE "AGREE", “ACCEPT” OR "YES" BUTTON OR ANY OTHER INDICATOR OF YOUR ELECTRONIC ACCEPTANCE OF THIS AGREEMENT, INSTALLING , ACCESSING THE WEBSITE ONLINE, OR, IF APPLICABLE, BREAKING THE SEAL OF THE TANGIBLE MEDIA CONTAINING OUR APPLICATION, YOU AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, THEN DO NOT CLICK THE "AGREE", "ACCEPT", OR "YES" BUTTONS OR OTHER INDICATOR OF YOUR ELECTRONIC ACCEPTANCE OF THIS AGREEMENT, AND DO NOT ACCESS OR USE THIS WEBSITE OR THE APPLICATION.

1. License

1.1 The Mobile Application Tarot Life which accompanies or is accessible through this license (“App", “Application” ) is the property of Innovana Astro Services Limited or its licensees and is protected by copyright law. While Innovana Astro Services Limited continues to own the intellectual property rights to the Application, you will have certain rights to use Tarot Life after your acceptance of this license. This license governs any releases, revisions, or enhancements to the application that Innovana Astro Services Limited may furnish

1.2 Tarot Life is completely free to install but includes certain advanced features, services, and products which require in-app payments.

1.3 You may uninstall this app at any time, using the standard uninstall procedures as offered with your mobile’s Operating System.

Our app requires an Internet connection to perform all functions like database updates, etc.

1.4 You are not entitled to:

• Use the Application in any way not authorized.
• Copy the documentation which accompanies the Application.
• Sub-license, rent or lease any portion of the Application.
• Reverse engineer, decompile, disassemble, modify, translate, make any attempt to discover the source code of the Application, or create derivative works from the Application.
• Use a previous version or copy of the Application after you have received a disk replacement set or an upgraded version. Upon upgrading the Application, all copies of the prior version must be destroyed.

2. Term & Termination

2.1 Term
The initial term of this Agreement will commence on the date you download Tarot Life.

2.2 Termination
Innovana Astro Services Limited, in addition to such other rights, may be available at law or equity, shall be entitled to terminate this Agreement at any time without notice if you commit a material breach of this Agreement.

2.3. Effect Of Termination
On the expiration or termination of this Agreement, you will cease using our Application, we may cease making Updates available to you, and the Application may cease functioning. Sections 1.4, 3, 4, 5, 6, 7, 8, 9, 10, 11 will survive the expiration or termination of this Agreement.

3. Ownership

Innovana Astro Services Limited reserves all rights in the Website/Application not expressly granted by this Agreement. All copyrights, trademarks and other conceivable intellectual property rights in and to the Website/Application are owned by Innovana Astro Services Limited or its licensors and are protected by Indian copyright laws, international treaties and other applicable laws. Any copy of the Application you are allowed to make pursuant to this Agreement must contain the entire copyright and other notices included with the original copy of the Application(s).

4. Content Updates

You acknowledge that our Application utilizes content and features that are updated from time to time. You further acknowledge that you must routinely download and permit installation of Updates in order to obtain maximum benefits from the Application.

5. Warranty

Innovana Astro Services Limited does not warrant that our Application will meet your requirements or that operation of the Application will be uninterrupted or error-free.

THE ABOVE WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE AND COUNTRY TO COUNTRY.

6. Privacy

6.1. Tarot Life may deliver any notice to you via a pop-up window, dialog box, email or other means, even though you may not receive the notice unless and until you launch the Application. Any such notice will be deemed delivered on the date our application first makes it available through the Website/Application, irrespective of when you actually receive it.

6.2. You acknowledge that our application collects certain information regarding the users of the Website/Applications, including certain personally identifiable information. You hereby give consent to our applications for collection and use of such information and agree that the collection and use of such information will be governed by Tarot Life Privacy Policy and that Tarot Life may revise the same from time to time.

6.3 By Agreeing to this EULA you grant us permission to use the reviews given by you for the product and your name on our website, price pages & other digital resources.

7. Disclaimer of Damages

EXCEPT AS EXPRESSLY PROVIDED BY SECTION 5 OF THIS AGREEMENT, Innovana Astro Services Limited DISCLAIMS ALL OTHER WARRANTIES WITH RESPECT TO THE APPLICATIONS, MEDIA AND ANY OTHER SUBJECT MATTER OF THIS AGREEMENT, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTY OF MERCHANTABILITY, THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE AND IMPLIED WARRANTY OF NONINFRINGEMENT. TAROT LIFE DOES NOT WARRANT THAT THE OPERATION OF THE WEBSITE/APPLICATIONS WILL BE UNINTERRUPTED OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON AN IMPLIED WARRANTY, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. YOU MAY HAVE OTHER RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION.

8. Limitation of Liability

8.1. SOME STATES AND COUNTRIES, INCLUDING MEMBER COUNTRIES OF THE EUROPEAN ECONOMIC AREA, DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE BELOW LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

8.2. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND REGARDLESS OF WHETHER ANY REMEDY SET FORTH HEREIN FAILS OF ITS ESSENTIAL PURPOSE AND NOTWITHSTANDING ANYTHING HEREIN TO THE CONTRARY:

1. IN NO EVENT WILL TAROT LIFE OR ITS LICENSORS HAVE ANY LIABILITY OR RESPONSIBILITY TO YOU WHATSOEVER FOR ANY DEFECT, MALFUNCTION, DAMAGE, OR LOSS, RESULTING FROM YOUR INSTALLATION OR USE OF THIRD-PARTY APPLICATION, HARDWARE, EQUIPMENT, PERIPHERALS, OR OTHER PRODUCTS, INCLUDING BUT NOT LIMITED TO, APPLICATION VERSION UPDATES, CONTENT UPDATES, OR OTHER FILES RECEIVED FROM ANY THIRD-PARTY (COLLECTIVELY, "THIRD PARTY PRODUCTS"), RECEIVED IN CONNECTION WITH YOUR (OR ANY THIRD PARTY'S) USE OF THE APPLICATION. ALL WARRANTIES AND OBLIGATIONS OF THIRD-PARTIES IN CONNECTION WITH THIRD-PARTY PRODUCTS ARE OUTSIDE THE SCOPE OF THIS AGREEMENT AND MUST BE ADDRESSED UNDER A SEPARATE AGREEMENT BETWEEN YOU AND SUCH THIRD-PARTIES.
2. IN NO EVENT WILL Innovana Astro Services Limited OR ITS LICENSORS BE LIABLE TO YOU FOR ANY SPECIAL, CONSEQUENTIAL, PUNITIVE, INDIRECT OR SIMILAR DAMAGES, INCLUDING ANY LOST PROFITS OR LOST DATA ARISING OUT OF THE USE OR INABILITY TO USE THE WEBSITE/APPLICATIONS, EVEN IF Innovana Astro Services Limited HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
3. IN NO EVENT WILL Innovana Astro Services Limited OR ITS LICENSORS' LIABILITY EXCEED THE PURCHASE PRICE OF THE APPLICATIONS/SERVICES.

8.3. THE DISCLAIMERS AND LIMITATIONS SET FORTH ABOVE APPLY REGARDLESS OF WHETHER YOU ACCEPT THE APPLICATIONS OR NOT.

9. Taxes

You shall be responsible for the payment of all sales, use and similar taxes relating to the license of the Application as applicable to your state/country and the respective taxation structure.

10. Export Control

The Website/Application and the underlying information and technology may not be accessed, downloaded or otherwise exported or re-exported. You must comply with all domestic and international export laws and regulations that apply to our applications and company. These laws include restrictions on destinations, end-users, and end use. You agree not to export our Application or related licenses to any prohibited country, entity, or person for which an export license or other governmental approval is required. Obtaining necessary licenses and approvals is solely your obligation. By accessing, downloading or using the Website/Application, you agree to the foregoing and you represent and warrant that you are not located in, under the control of, or a national or resident of any such country which might fall under any type of restricted list.

11. General Terms

11.1. Indian Laws govern the interpretation of this agreement and apply to claims for breach of it, regardless of conflict of laws and principles. Jurisdiction over and venue of any suit arising out of or related to this agreement will be in the courts located in Jaipur. If any provision of this agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this agreement, which shall remain in full force and effect. No waiver of any term of this agreement shall be deemed further or continuing waiver of such term or any other term.

11.2. This Agreement was originally prepared in the English language. Although Tarot Life may provide one or more translations for your convenience, the English version will control in the case of any conflict or discrepancy.

11.3. This agreement constitutes the entire agreement between you and Innovana Astro Services Limited with respect to this transaction and any prior statements or representations. Any changes to this agreement must be made in writing, signed by an authorized representative of Innovana Astro Services Limited.

12. Our Services and Access to Use

Subscription

We offer Annual as well as Monthly Subscription to our users that begins as soon as your initial payment is processed. The subscription or services will automatically renew for the same price and duration as the original subscription package chosen by you unless you turn off/cancel its auto-renewal. 

For Apple Users (App Store): Your account will be charged for renewal within 24-hours prior to the end of the current subscription period. Thus, if you do not want to auto-renew the subscription, you need to cancel the subscription at least 24-hours before the end of the existing subscription period. You may cancel the auto-renewal by following these steps:

Step 1: Go to the Settings of your iphone.

Step 2: Click on your Apple Id icon at the top.

Step 3: Select “Subscriptions” from the menu.

Step 4: Click on our application from the list of active subscriptions

Step 5 : Tap on Cancel Subscription and then click Confirm.

For Android Users (Google Play Store): You will be charged for auto-renewal only at the end of the subscription period. You may cancel the auto-renewal of subscription anytime before the end of the current subscription period by following these steps :

Step 1: Go to Google Play Store on your phone.

Step 2: Tap the menu bar and go to Subscription.

Step 3: Find our application from the list of apps you have subscribed to.

Step 4: Click on the application and then on Cancel Subscription.

Step 5: Choose the reason for cancellation and tap on Continue.

Note - In case of any use or misuse of account and password in any manner, we reserve the right to block access to all the users from that IP address and cancel the access immediately without prior notice. Moreover, you shall be solely responsible for all or any activities that occur under your account. You provide your consent to notify us immediately of any unauthorized access to your account or any breach of security. In case of any loss due to usage of your account or password by someone else, we, in any case, will not be made responsible. However, you could be liable for losses incurred by us or another party to someone else using your password or account.

Billing (if applicable)

By signing up for Tarot Life’s subscription or other services by the app or website, you are sharing your consent that Tarot Life is authorized to charge you subscription fees as per your selected plan, any other fees for additional services you may buy, and any other applicable taxes related to use of Tarot Life services through the credit card or other payment method accepted by the company.

If there is any change in registered credit card validity or expiration details, you may edit your payment information by clicking on your account. If your Payment Method expires and you do not edit your payment method information or cancel your account, you permit us to continue billing, and you will remain liable for any collected amounts.

As used in these Terms, "billing" shall represent either a charge or debit, as applicable, against your Payment Method. You will be billed with a subscription fee at the beginning of your subscription and on each subsequent renewal (as per selected by you) thereafter until and unless you cancel your account or subscription or service is otherwise discontinued or suspended following these terms. In order to confirm or see the commencement date of your next billing or renewal period, go to the account page and check the section of billing information. 

In order to continue with Tarot Life services, it is necessary that you respect the payment obligations to which you shared your consent. The Company reserves the right to follow any amounts you fail to pay in relation to Tarot Life services. You will be responsible to the Company for all such amounts and costs incurred by the Company in relation to the collection of these amounts, comprising, without limitation, collection agency fees, reasonable attorneys’ fees, and arbitration or court costs.

Mobile "In-App" Purchases: When you make any In-App purchase from a Mobile App Store Platform, including subscriptions, Astrology reports and Ask A Question, the payment of such purchases may be processed either by third parties (Stripe, Dodo, XPay & Razorpay) on our behalf, Apple Pay or directly by the mobile app provider such as Google Play or Apple iTunes, from which you have originally downloaded the application. You may access the applicable "in-app" purchase rules and policies directly from the Mobile App Store Provider's terms and conditions/EULA.

You will be solely responsible for the authenticity and accuracy of the information shared by you, comprising the credit card details and the like. You accept and understand that we, in any way, shall not be responsible or held liable for any losses whatsoever, whether direct, indirect, incidental or consequential, comprising without limitation any losses because of delay in payment processing instruction or any credit card fraud. With regards to your rights to cancel orders and get related refunds, you must accept and agree with the terms and conditions of the respective Mobile App store provider.

You accept and agree that all the billing and transaction processes are handled by the Mobile App Store Provider from whose platform you have downloaded the app, Apple Pay, the third party payment gateways Stripe and Razorpay and are governed by the respective App Store or Payment Provider’s terms and conditions/EULA. In case of any issues related to payment with In-App Purchases, please contact the App Store/Payment Provider directly.
